Desmarais LLP Earns Defense Win for Intel in Tech Patent Lawsuit

Patent Litigation for the Defendant

Desmarais LLP secured a full defense victory for Intel Corp. in Delaware federal court, defeating a lawsuit that alleged patent infringement against the chipmaker’s central processing units.
 
In a ruling on February 22, 2023, Judge Matthew Kennelly granted Intel's motion for summary judgment of noninfringement on all claims brought by XMTT Inc. The suit alleged that virtually all of Intel’s desktop and mobile processors since 2012 infringed two of XMTT’s patents (Nos. 7,707,388 and 8,145,879) related to computer memory architecture in hybrid serial and parallel computing systems. XMTT, represented by Morgan Chu at Irell & Manella LLP, had filed the lawsuit in 2018, and it was scheduled for trial in April 2023.
 
The summary judgment ruling hinged on the court’s interpretation of the term “serial processor.” Judge Kennelly adopted Desmarais LLP’s proposed definition as a “processor that executes instructions one at a time, in a sequential manner.” The court’s decision meant the central processing units Intel sold were not covered by XMTT’s patents, and this led the court to agree with Desmarais LLP’s argument that Intel was “entitled to summary judgment because no reasonable jury could find that the accused products—Intel’s CPUs—are serial processors under this construction.”
