Desmarais LLP Secures Defense Victory for Intel before the Federal Circuit

The Federal Circuit upheld a major Desmarais LLP defense win for Intel, definitively rejecting a lawsuit brought by XMTT, Inc. that alleged patent infringement against virtually all of Intel’s desktop and mobile processors sold since 2012.
 
The ruling, issued December 4, 2024, affirmed a summary judgment win that Desmarais LLP secured for Intel in the District of Delaware last year.  XMTT (represented by Morgan Chu and others at Irell & Manella) filed the lawsuit in November 2018 alleging infringement of two patents (Nos. 7,707,388 and 8,145,879) related to computer memory architecture in hybrid serial and parallel computing systems.
 
In February 2023, federal court Judge Matthew Kennelly found in Intel’s favor, granting summary judgment of noninfringement against all of XMTT’s patent claims. The complete defense victory eliminated the need for a trial, which was scheduled for April 2023. In the ruling, Judge Kennelly agreed with Desmarais LLP’s claim construction arguments regarding “serial processor,” a critical term in the case, and concluded that “no reasonable jury could find that the accused products – Intel’s CPUs – are serial processors.”
