Desmarais LLP partner Leslie Spencer spoke with Managing IP about how the coronavirus pandemic has generated a backlog in intellectual property cases awaiting trial across the industry, and she explained how this delay has given attorneys a valuable opportunity to sharpen their arguments as they prepare to go to court.
Spencer told Managing IP that the extra time is useful, especially for defense attorneys, as they work to coordinate with witnesses to prepare them to testify at trial and as they research all facets of the case. “If it’s clear that there’s more time in the schedule, it creates more opportunity for third-party discovery that the case otherwise wouldn’t allow for,” she said.
The additional time also gives next-generation attorneys more chances to hone their litigation skills as they work with lead partners on the case, practicing mock arguments and reviewing trial presentations, Spencer said.
