Desmarais LLP Defeats Labcorp’s Attempt to Undermine Ravgen’s Trial Victory

Desmarais LLP earned a district court victory that rejected Labcorp’s attempt to retry a prior Ravgen victory. That jury trial victory resulted in a non-invasive prenatal genetic testing patent being found willfully infringed, not invalid, and a total damages award of nearly $400 million.
 
On February 12, 2025, Judge Alan Albright of the Western District of Texas confirmed that victory, and ruled against all of Labcorp’s post-trial challenges to the jury verdict, writing that “substantial evidence supports the jury’s verdict” and “substantial evidence supports the jury’s damages award.”
 
In September 2022, a federal jury in Waco, Texas, found that Labcorp had willfully infringed Ravgen’s genetic testing technology and awarded $272.5 million in damages. The court in May 2023 enhanced the damages by $100 million bringing the total to $372.5 million. Ravgen originally filed the patent infringement lawsuit against Labcorp in October 2018.
 
Desmarais LLP also secured recent wins for Ravgen before the Federal Circuit in three cases. In the rulings issued in January 2025, the Federal Circuit upheld all Patent Trial and Appeal Board (PTAB) findings that rejected all invalidity challenges brought by Labcorp and Streck against Ravgen’s patents (Nos. 7,332,277 and 7,727,720). Those rulings preserved $429.5 million in patent infringement damages Desmarais LLP won for Ravgen in district court actions against Labcorp and Natera.
