The Daily Journal named Desmarais LLP partner Betty Chen to its Top Intellectual Property Lawyers for 2025, highlighting her achievements in the courtroom during the last 12 months and discussing how patent litigation has evolved during her career.
In a recent case representing Microsoft, Chen successfully defended the company against patent claims brought by MediaPointe that its content delivery network infringed two patents. Chen’s work led to the invalidation of several patent claims and a summary judgment of non-infringement ruling.
“I love the nuances of IP law, particularly because it has been ever-changing over the past 20 years: first in the areas of patent damages and claim construction, then in terms of patent eligibility, and now in the intersection of litigation and post-grant review,” Chen told the Daily Journal.
Chen also detailed a current case, which exemplifies the multi-jurisdictional nature of modern patent litigation. She represents a medical device and pharmaceutical company in a lawsuit spanning both the district courts and the International Trade Commission, which, in addition to patent claims, includes Lanham and unfair competition claims.
“The key takeaway here is that it is important to approach disputes as exercises in problem-solving, looking for solutions that best serve the client's needs, regardless of whether litigation occurs in a single venue or across multiple jurisdictions,” Chen told the Daily Journal.
