Managing IP has recognized Desmarais LLP in four categories in the annual Americas Awards 2022, based on the firm's patent litigation successes across the district and appellate courts and victories before the Patent Trial and Appeal Board.

Now in its 17th year, the
Managing IP Americas Awards highlight the industry’s leading intellectual property practitioners and firms. As part of a comprehensive evaluation and selection process, research analysts assess thousands of IP practitioners, firms, and their clients to arrive at the shortlist. This includes conducting interviews, gathering survey data, reviewing submissions, and examining court and IP office records.
Managing IP then selects honorees based on their achievements during the last 12 months, including high-profile victories and significant contributions to IP law.
Desmarais LLP earned several major wins during the past year. The firm notched a settlement in February 2022 for ViiV Healthcare and Shionogi & Co. that included a $1.25 billion upfront payment and a 3% ongoing royalty from Gilead Sciences. The firm also secured $1.9 million in attorneys' fees in May 2021 for Cisco after winning a Federal Circuit summary affirmance, a unique ruling where the court recognized flat-fee billing as an alternative to the hourly lodestar method. And Desmarais LLP achieved a significant settlement for Avanos Medical in October 2021 following several pre-trial victories against Medtronic in a patent infringement case involving a high-tech pain treatment device.
The firm also obtained numerous wins before the PTAB for petitioners and patent owners. These included preventing institution on
inter partes review challenges to tech and life sciences patents for IBM, Monterey Research, Gigamon, and Ravgen; defeating Medtronic’s IPR challenge to Avanos’s patent; invalidating a large number of challenged claims in a case for Samsung; and advancing reexams for both Unified Patents and Johnson & Johnson’s Auris Health.
