The Federal Circuit issued a Rule 36 summary affirmance that preserved Desmarais LLP’s district court victory for client, Cisco Systems, which included a $1.9 million award of attorneys’ fees following the firm’s successful defeat of a patent infringement lawsuit.
Brought by Straight Path IP Group (now SPIP Litigation Group), the litigation involved point-to-point Internet communication technology and sought up to $123 million in damages. Desmarais LLP secured a complete summary judgment win for Cisco in 2017 just three months after taking over the case, and the Federal Circuit upheld the victory in 2019.
The lower court – the U.S. District Court for the Northern District of California – then awarded Cisco $1.9 million in attorneys’ fees in the case, and the Federal Circuit on May 11, 2021 upheld that ruling. “We are pleased with the Federal Circuit’s affirmance of Judge Alsup’s ruling,” said partner Justin Wilcox, who argued the case before the Federal Circuit.
Desmarais LLP founding partner John Desmarais and associate Steven Balcof also represented Cisco in the case.
