Tamir Packin

Law360 has named Desmarais LLP Partner Tamir Packin a 2020 Rising Star highlighting his complete defense victory for Cisco Systems in a trial involving more than $400 million in damages claims.
 
In January 2019, Packin led Desmarais LLP’s defense of Cisco in a three-day bench trial in a patent infringement case in Massachusetts federal court brought by software company Egenera over a virtual networking patent. Five months later, in May 2019, the judge ruled in Cisco’s favor, fully agreeing with Packin's arguments at trial.
 
In the courtroom, Packin used an aggressive strategy that called the opposition’s two key witnesses to the stand during his case-in-chief. Over the course of the trial, he successfully showed that the removal of one of the original inventors of the patent had invalidated it. The judge agreed and referred to the witnesses’ testimony as “historical revisionism.”
 
In an interview with Law360, Packin explained his approach to trying cases – he seeks to build a true rapport with a jury, avoiding lengthy PowerPoint slideshows and opting for a simple foam board and in-person demonstrations to make his arguments.
 
“At root, trials are really a human-to-human interaction, and you need to connect with people, and you need your witnesses to connect with people,” he said. “And sometimes too much technology gets in the way of that.”
 
Packin also discussed how he prepares for cases and why he is so driven to win. He said that over the years he has built strong relationships with clients that have deepened into friendships and he seeks to exhaust every option to ensure his clients succeed at trial. That means putting in long hours to thoroughly research and strategize all aspects of a case.
 
"I'm very competitive. I don't think you can find a successful trial lawyer who is not. So I'm very much an all-or-nothing kind of guy," Packin told Law360. "You win cases, you lose cases, but I wouldn't be able to sleep at night if I lost a case and it was just because I didn't put in the effort."
